1. Acceptance of Terms
By accessing or using the Phantom Vault platform (“Service”), operated by Phantom Data LLC (“Company”, “we”, “us”), you (“Client”, “you”) agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Service Description
Phantom Vault provides homeowner contact data including names, phone numbers, email addresses, and property addresses sourced from publicly available records. Data is delivered electronically via CSV download, email, or API.
3. Permitted Use
You may use data obtained through the Service for lawful business purposes only, including but not limited to direct mail, SMS marketing, cold calling, and digital advertising — provided you comply with all applicable federal, state, and local laws.
4. Prohibited Use
You agree NOT to:
- Use the data for any illegal purpose or in violation of any applicable law
- Resell, sublicense, or redistribute the data to third parties without written authorization
- Use the data to harass, stalk, threaten, or defraud any individual
- Attempt to reverse-engineer, scrape, or extract data from the platform beyond your authorized access
- Share your account credentials with unauthorized users
5. TCPA and Do-Not-Call Compliance
While Phantom Vault makes reasonable efforts to provide data that has been scrubbed against known Do-Not-Call (DNC) lists and TCPA litigator databases, it is your sole responsibility to ensure compliance with the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), CAN-SPAM Act, and all applicable state and federal Do-Not-Call regulations before contacting any individual.
You agree to independently verify compliance before initiating any outbound communications (calls, texts, emails) using data obtained through the Service. Phantom Data LLC shall not be held liable for any violations of telecommunications or marketing regulations arising from your use of the data.
6. Data Accuracy
Data is sourced from public records and third-party providers. While we strive for accuracy, we do not guarantee that all records are current, complete, or error-free. Contact information (phone numbers, emails) may be outdated. Data is provided “as-is” without warranty of any kind.
7. Account Security
You are responsible for maintaining the confidentiality of your account credentials. Each account is for a single authorized user unless otherwise agreed in writing. We enforce single-session login and may terminate accounts suspected of credential sharing.
8. Payment and Billing
Subscription fees are billed monthly in advance. Pay-per-record and bundle pricing is billed upon order completion. All fees are non-refundable once data has been delivered. Failure to pay may result in account suspension and termination of access.
9. Record Limits and Overages
Your plan includes a monthly record allocation. Usage beyond your allocation may incur overage charges at the rate specified in your service agreement. We reserve the right to throttle or suspend service for accounts that significantly exceed their allocation without prior arrangement.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHANTOM DATA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
Our total liability for any claim arising from the Service shall not exceed the fees you paid to us in the three (3) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Phantom Data LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the data, your violation of these Terms, or your violation of any law or regulation.
12. Termination
We may suspend or terminate your account at any time for violation of these Terms, non-payment, or at our sole discretion with reasonable notice. Upon termination, your access to the platform and any undelivered data will cease immediately.
13. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or platform notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration.
